CMS Announces Option to Opt-out of MIPS for 2020

CMS is announcing that MIPS eligible clinicians will have the choice to opt-out completely or partially from the 2020 MIPS program by completing a hardship exemption application and indicating that it is due to the COVID-19 Public Health Emergency. Individual clinicians and group practices will have until December 31, 2020 to complete the hardship application. Practices will be able to select partial exemption or complete exemption on the application. The partial exemption option requires the practice to indicate that they do not want to be scored on the Cost and Quality categories and instead have their score calculated based on just Promoting Interoperability and Improvement Activities. The complete exemption option will allow the practice to opt-out of all four performance categories and will result in no payment adjustment for the 2022 payment year. However, if a practice submits ANY MIPS data to CMS, the practice will be scored on their submission.

The CMS website is in the process of being updated with this new policy and should reflect the announcement along with additional educational materials within the next few weeks. Please note that the information currently posted on the website relates to the 2019 MIPS COVID-19 policy. Additionally, CMS has also indicated that more information on MIPS COVID-19 policy will be forthcoming in upcoming rulemaking.
