AANEM Advocacy in Indiana Pays Off: Chiropractors Still Can’t Perform Needle EMGs

​AANEM policy staff teamed up with the Indiana Medical Association and ASET – The Neurodiagnostic Society – to amend a bill in Indiana that would have changed state law to permit chiropractors to perform needle EMGs. Indiana is one of the few states where chiropractors are expressly prohibited from performing needle EMG studies (see Indiana Code 25-10-1-1(1)(C)). 

Indiana House Bill 1384 sought to greatly expand chiropractors’ scope of practice. The bill did pass through both houses in the Indiana legislature at the end of February 2018, but it did so without the language that would have allowed them to perform needle EMG studies. 

According to AANEM Health Policy Director, Millie Suk, JD, MPP, “As soon as we learned of the bill, thanks to staff at ASET and our legislative tracking software, we contacted the Indiana Medical Association and immediately explained our concerns. They were great to work with, lining up physicians to testify against the provision.” Suk went on to explain, “While AANEM certainly counts this as a win in our efforts to ensure patients receive EDX testing only from qualified providers, we know this is an ongoing battle. Instead of trying to fight the battle on a state-by-state basis, AANEM is focusing its efforts to mandate standards for EDX testing on the national level.” 

AANEM State Liaisons will return to Capitol Hill at the end of April 2018 to meet with and educate their congressional representatives on the issue. While there, AANEM staff and representatives are also planning to meet with Medicare to discuss this issue and other Medicare issues, such as the burdens of the Quality Payment Program, relevant to AANEM members.
